• As a YLAC fellow, I worked with a Member of Parliament (MP) on a social development project.
• The project revolved around analysis of the data protection and privacy issues that emerge in light of the Aadhaar initiative and the recent Supreme Court judgement granting privacy the status of a fundamental right.
• Responsibilities included:
• 1) Analysis of the Data (Privacy and Protection) Bill as well as the Supreme Court judgement on the ‘Right to Privacy’
• 2) Suggesting scenarios and identifying ‘narrowly defined exceptions’ in each case;
• 3) Drafting a policy directive that may be issued to government departments to test whether a scheme or a set of records (PAN cards, bank accounts etc.) may be linked with Aadhaar;
• 4) Comparing standards for seeking consent for data use in different countries;
• 5) Preparing advocacy material for building awareness on the issue of data privacy and informed consent.
